Terms of Sale

1. Parties and Subject

This Distance Sales Agreement is concluded electronically between the Seller identified below and the Buyer who purchases digital tokens through the Be My Guest application.

Buyer: The name, surname and e-mail registered on your Be My Guest account.

2. Product: Tokens

A token is a digital unit that provides access to certain functions within the Be My Guest application. There are two types:

  • Host Token: Used to create an event.
  • Guest Token: Used to apply to join an event.

Tokens are sold in packages. The number of tokens in each package and its current price are shown on the purchase screen before you complete the purchase.

3. Payment and Delivery

  • All purchases are made through Google Play. Payment is collected by Google's payment infrastructure; the Seller neither sees nor stores your card details.
  • Prices are displayed by Google Play in the currency of your country and include all applicable taxes.
  • Once Google confirms the payment, tokens are credited to your account immediately. There is no physical delivery.
  • If a technical fault prevents the tokens from reaching your account, contact us at info@bemyguestapp.net.

4. Right of Withdrawal

Tokens are digital content delivered immediately upon payment confirmation. Under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, there is no right of withdrawal for contracts concerning intangible goods performed and delivered instantly in an electronic environment. By confirming your purchase, you request immediate delivery of the tokens and accept that your right of withdrawal thereby ends.

If you are a consumer in the European Union, the mandatory consumer-protection provisions of your country of residence continue to apply, including any right of withdrawal granted to you there. Nothing in this section limits those rights.

This does not affect your rights under the Google Play refund policy described below.

5. Refund Policy

  • Since purchases are made through Google Play, refund requests are subject to Google Play's refund policy. Google evaluates requests made within a certain period after purchase according to its own rules.
  • You can submit a refund request through your Google Play account or via the Google Play support page.
  • When a purchase is refunded, the tokens credited by that purchase are reclaimed. If those tokens have already been spent, your balance may go negative; the shortfall is offset against your future purchases.

6. Use and Limits of Tokens

Tokens may be purchased, or granted free of charge at the Seller's discretion (on registration or as part of a campaign). Free and purchased tokens are functionally identical, and all of the rules below apply equally to both.

  • Tokens have no cash value and cannot be exchanged for money.
  • Tokens are non-transferable. They cannot be gifted, sold or moved to another user. Accounts are likewise non-transferable.
  • Account deletion: If you delete your account, any unused tokens are forfeited and cannot be refunded.
  • Account freeze: If you temporarily freeze your account, unused tokens are preserved and become available again when you reactivate.
  • Breach of rules: If your account is closed for breaching the Terms of Use, unused tokens are forfeited without refund.
  • Tokens have no expiry date; they do not lapse and are not invalidated for being unused. They remain available as long as your account is open.

7. Price Changes

The Seller reserves the right to change the prices and contents of token packages. Price changes are not retroactive; the quantity and validity of tokens you have already purchased are unaffected.

8. Dispute Resolution

Consumers residing in Türkiye may apply to the Consumer Arbitration Committees and Consumer Courts at their place of residence or where the transaction took place. Monetary thresholds are announced annually by the Ministry of Trade.

For users residing outside Türkiye, the mandatory provisions of the consumer legislation of your country of residence are reserved, and you may bring proceedings before the competent authorities of your place of residence.

For disputes arising from this agreement that fall outside the scope of consumer legislation, the laws of the Republic of Türkiye apply and the courts and enforcement offices of Sivas have jurisdiction.

9. Prior Information

Before confirming the purchase, the Buyer declares that they have been informed of the essential characteristics of the product, the total price including taxes, the method of payment and delivery, the absence of a right of withdrawal, and how to submit complaints; and that they have read and accepted this agreement.

11. Governing Text

In the event of any discrepancy between the Turkish and English versions of this agreement, the Turkish text prevails.
